These Terms and Conditions (“Terms”) govern your access to and use of all websites, mobile applications, software, products, and services (collectively, the “Services”) operated by Costea & Associates, a Georgia limited liability company, doing business as KCM Labs (“Company,” “we,” “us,” or “our”).

By accessing or using any of the Services, including but not limited to mobile applications, websites, or digital products, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for personal, non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved by the Company.

4. Intellectual Property

All Services and all associated content, including but not limited to source code and software, game mechanics and logic, visual designs, layouts, graphics, and artwork, logos, trademarks, and branding, and text, audio, and video content, are the exclusive property of the Company or its licensors and are protected by applicable intellectual property laws.

You may not:

• Copy, reproduce, distribute, or modify any portion of the Services.
• Reverse engineer, decompile, or attempt to extract source code.
• Create derivative works based on the Services.
• Use the Services for commercial purposes without written permission.

5. No Affiliation or Endorsement

The Services are independently developed and are not affiliated with, endorsed by, sponsored by, or associated with any third-party brand, platform, or trademark, unless explicitly stated.

6. Third-Party Services and Advertising

The Services may integrate or display third-party services, including but not limited to advertising networks (such as Google AdMob), analytics services, hosting providers, and payment processors (if applicable). The Company does not control and is not responsible for third-party services or their data practices.

7. Modifications and Availability

The Company reserves the right to modify, suspend, or discontinue any part of the Services, add or remove features or content, or restrict access at any time. The Company shall not be liable for any such changes.

8. Disclaimer of Warranties

ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY. THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSTEA & ASSOCIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR DEVICE OR SYSTEM DAMAGE. THE COMPANY’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY, IF ANY.

10. Indemnification

You agree to indemnify and hold harmless the Company, its members, managers, employees, and affiliates from any claims, damages, losses, or expenses arising from your use or misuse of the Services, your violation of these Terms, or your violation of any law or third-party rights.

11. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the state or federal courts located in Georgia.

12. Changes to These Terms

The Company may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
